COLLECTIONS LAWSUITS

Get far enough behind in credit debt and the day will probably come when there will be a knock at the door and you will be served with a summons and complaint by a process server. You are now the defendant in a collections lawsuit filed by a credit card company through their attorneys, asking for back amount owed plus interest and penalties and attorneys fees. This situation usually comes as a shock to most people, and in a lot of cases they don't act promptly. That's a mistake, because if you don't answer a lawsuit within 30 days, the creditor can get a default judgment against you. That judgment will stay on your credit report for years and expose you to serious damage. Most commercial debt settlement companies are not equipped to handle these lawsuits. We are a law firm. We know the drill, and we can help you determine whether to file a bankruptcy, which will halt the lawsuit in its tracks, or file a response at court to stop that default judgment and extend the time period while we negotiate a settlement with the creditor. Quick and decisive action is best once a lawsuit is begun. We have the experience and skills to help you find the right course of action.

WAGE GARNISHMENT

If a creditor gets a judgment against you, the creditor may attempt to garnish your wages. That means a withdrawal from your pay before you ever see it. It is a favorite technique of judgment creditors and also the IRS. It isn't pleasant to see your money taken out of your pay. We recommend not letting the situation get this far. It is much better to deal with the debt problem before the creditor gets a judgment and starts to garnish. Still, wage garnishment can be stopped by filing bankruptcy, or by negotiating with the creditor.

LIENS AND LEVIES

A lien is an encumbrance on some property. A levy is an actual seizure of property, such as the money in your bank account, to pay a debt. With a judgment, a creditor can move to seize your property. It is clearly best to deal with a collections lawsuit before a judgment is obtained against you. We can help you take care of the situation so that it can be resolved and you are not exposed to the loss of your money and property.

It is important to deal with collection lawsuits before they cause you damage. If you have been sued by a creditor, or if you have received letters from the IRS or another tax agency, let us take care of it for you. We speak their language and we can probably find a solution that will save you a good deal of money.

Do not put off dealing with lawsuits, garnishments or tax problems.
