HOW CAN A CHAPTER 7 BANKRUPTCY HELP YOU?

ELIMINATE CREDIT CARD DEBT

Credit Card Debt is considered "unsecured debt." A Chapter 7 Bankruptcy is specifically intended to help people in financial trouble by eliminating unsecured debt. If you qualify for Bankruptcy protection, the Bankruptcy Court will grant total relief - TOTAL RELIEF - from Credit Card Debt! It sounds unbelievable, but there is no catch and no trick. Without help, Americans could spend the rest of their lives as slaves to exorbitant interest rates from credit card companies. It's not the American way, and Bankruptcy is the way the Federal Government has developed to avoid that situation and give Americans a chance for a new start.

ELIMINATE CERTAIN CATEGORIES OF TAX DEBT

The relationship between tax issues and bankruptcy is often confusing. There are very specific rules about what kinds of tax debt can be discharged in a Chapter 7 Bankruptcy. They are as follows:
  (1) The due date for filing a tax return for the year in question was at least three years ago.
  (2) The tax return was filed at least two years ago
  (3) The tax assessment, if one was done, is at least 240 days old
  (4) The tax return was not fraudulent
  (5) The taxpayer is not guilty of tax evasion

If all of these rules apply to the tax years to which your debts apply, the taxes may be discharged.

ELIMINATE HOSPITAL BILLS

Hospital bills are another form of unsecured debt, and everyone knows that an illness or injury, especially for people who are uninsured or underinsured, can have a devastating effect. Even a short stay in a hospital or other type of medical facility can cost an amount far beyond the capacity of most people to pay, and hospitals are just as apt to pass their unpaid bills over to collection agencies as credit card companies, resulting in the same types of harassing phone calls and collection letters. Hospital bills are also totally eliminated by Chapter 7 Bankruptcy.

STOP LAWSUITS, JUDGMENTS AND WAGE GARNISHMENT

The end of the line for a collection agency is to file a lawsuit against people who owe money on credit cards, hospital bills or other types of debt. It costs money to fight these lawsuits, and most people simply cannot afford it. The creditors win the lawsuit by default, obtain a judgment against the debtors, and then go about putting liens on property or garnishing wages. A Chapter 7 Bankruptcy stops this type of activity in its tracks. Lawsuits cannot be filed, pending lawsuits are stopped, and wage garnishments are ended. Bankruptcy is a seriously powerful tool.
