CREDIT CARD DEBT
It is so easy to fall into the trap of using credit cards and then find ourselves in a position where the very best we can do is to simply pay the "'minimum monthly payment," which is little more than the interest on the debt itself. By doing this, payments will continue almost forever. If you meet the qualifications (and most people can), a Chapter 7 Bankruptcy can eliminate that debt, stop creditor phone calls, and leave you free of all your unsecured debt. Hospital bills, lawsuits and even many kinds of tax debts, including IRS debt, can also be eliminated. But if bankruptcy is not a viable or desirable method, perhaps because your income is too high or you have too much equity in a home, we also have the option to pursue a course of Debt Settlement, meaning direct negotiation with creditors to arrive at a reduced settlement amount and an affordable installment payment plan.
MORTGAGE FORECLOSURES
Fall 3 months behind in your mortgage payments and you will soon be receiving a notice of default from your lender. If you cannot make up the amount owed, the next step is a notice of foreclosure sale, and your house will be sold at auction, very probably back to the lender, who can then sell it to someone else. This is the situation tens of thousands of people are now facing EVEN THOUGH THEY COULD MAKE UP THOSE BACK PAYMENTS IF THEY WERE GIVEN ENOUGH TIME TO DO SO. That is what a Chapter 13 Bankruptcy is intended to do. TAX DEBT
When the tax man comes knocking on your door claiming that you 'made an error' in your tax calculations, he'll be asking for interest and penalties that increase the size of the debt enormously. When that happens you may need some help coming up with a workable solution. You may be able to discharge the debt completely in Bankruptcy if you meet the requirements. Or you may be able to go back and amend your tax forms. You might be able to make an Installment Agreement with the tax agency. You may even be able to make what is called an 'Offer In Compromise,' which is a negotiated agreement with the tax agency to reduce the amount you owe. COLLECTIONS LAWSUITS
If you have received a Complaint and Summons from a credtor, meaning that a lawsuit has been filed against you, it is important that you take quick action. If you do not respond within 30 days from the time you receive the notice of the suit, the creditor can get a default judgment which they can use to garnish your wages, levy your bank accounts or put a lien on your property. We will discuss your options with you and determine the best way to solve the problem, either by filing a bankruptcy or by answering the suit and then negotiating a settlement for a reduced amount, to be paid in installments that you can afford.
